Milwaukee Thunderbolt Challenge 2019
Terms and Conditions (the “Agreement”)
1. The Milwaukee Thunderbolt Challenge 2019 ("Promotion") is promoted by Techtronic Industries (UK) Ltd ("Promoter").
2. Entry into Promotion is deemed acceptance of this Agreement.
3. The Promotion is applicable to residents in a participating European country (Austria, Belgium, Denmark, Finland, France, Germany, Ireland, Italy, Netherlands, Norway, Poland, Portugal, Russia, Spain, Sweden, Switzerland, United Kingdom) who are aged 18 years or over at the date of entry. The Promotion will be void and non-applicable where prohibited by law and is subject to all applicable local laws accordingly.
4. Employees, officers and directors of Promoter and its affiliated companies are not eligible to participate.
5. Proof of eligibility may be required, and prizes withheld until Promoter is fully satisfied the above criteria are met. Promoter’s decision is final, and no correspondence will be entered into.
6. The Promotion is limited to a maximum of one claim per person. Any entrant found to be cheating will be excluded.
7. There is no entry fee and no purchase necessary to enter this Promotion.
8. The Promotion is a game of skill, and no element of chance is involved in determining the winner(s).
9. Entry into the Promotion is open from April 2019 until September 2019 (“Entry Period”).
10. To enter the Promotion entrants must attend one of the designated live events held by the Promotor during the Entry Period. Information on all the live events can be found at: https://thunderbolt.milwaukeetool.eu/eu/find-an-event/ Promoter reserves the right to make changes to this schedule without prior notice.
11. The Promoter and its representatives present at the live events may refuse entry where, in its sole discretion, they determine that an entrant is under the influence of alcohol or drugs or is otherwise subject to any physical or mental condition that the Promoter, in its sole discretion, believes there to be an unacceptable level of risk to health or safety of the entrant or other spectators including but not limited to members of staff and event workers.
12. Entrants may enter the Promotion a maximum of one time per live event.
13. Promoter’s representative shall provide entrants with the relevant safety equipment to be used and/or worn for the duration of the challenge. All entrants enter the Promotion solely at their own risk and the Promoter does not guarantee the safety equipment will prevent any injury.
14. Under supervision of the Promoter’s representative(s), entrants must build the thunderbolt rig and fasten 6 bolts using the Milwaukee M12 ‘stubby’ impact wrench as quickly as possible. Further details are provided in section 15 and entrants who do not complete all the steps will be disqualified from the Promotion.
15. The steps to enter the challenge are as follows:
i. entrants must enter their full name; email address; trade description and accept the Agreement on the device provided by Promoter’s representative(s) at the respective event;
ii. entrants must dismantle the rig;
iii. entrants must start the timer by pressing the timer button using their hand which is used to operate the wrench;
iv. entrants must assemble and build the thunderbolt rig, fastening 6 bolts using the Milwaukee M12 ‘stubby’ impact wrench as quickly as possible;
v. entrants must stop the timer by pressing the timer button using their hand which is used to operate the wrench; and
Promoter’s representative(s) shall then record the final time, and this will appear on a leader board displayed at the local event and/or published on the Promoter’s website.
16. Winners shall be determined as follows:
i. Event Winner: on the day of the local event, details of which are found here https://thunderbolt.milwaukeetool.eu/eu/find-an-event/ Promoter will determine which entrant completed the challenge the quickest on that day and will be determined as the winner of the local event (“Event Winner”). Event Winner shall automatically be entered into a national final for the country where Event Winner competed and won (“National Final”). Event Winner will also win a Milwaukee M12 Stubby. The top 10 quickest entrants from each country shall also automatically be entered into the National Final.
ii. National Winner: The National Finalists will be announced on the 06th December 2019 (“National Winner”). National Winners shall automatically be entered into a European final in the UK (“European Final”). National Winner will also win the Milwaukee M12 range as set out in Annex 1.
iii. European Winner: The European Final shall be held 03rd – 13th February 2020 at a venue in Monaco. The Promoter will determine which entrant completed the challenge the quickest and will be determined as the winner of the European event (“European Winner”). European Winner will win the Milwaukee tools listed in Annex 2 worth 15,000.00 Euros. The Promoter will cover return travel to the location; meals and accommodation will be provided for National Winners to travel to the European Final. Further costs or expenditure shall be the sole responsibility of the National Winners.
iv. if a draw occurs of the quickest time for any of the events, Promoter may require drawing entrants to participate in a knock-out challenge as determined by the Promoter’s representative(s).
v. if any entrants decline or are unable to attend the National Event or European Event, they will not be eligible to proceed with the Promotion and retrieve any prizes. Under such circumstances, Promoter shall determine a replacement winner by using the next quickest entrant to complete the challenges.
17. Prizes cannot be transferred or exchanged. The Promoter is not responsible for inaccurate prize details supplied to any entrant and no cash alternative to the prize will be offered. The prize is subject to availability and the Promoter reserves the right to substitute the prize with another of similar characteristics and value. Prizes will be delivered at the Promoter’s cost to all winners within 8 weeks after the European Final, unless agreed otherwise. The Promoter will use reasonable efforts to distribute all prizes.
18. The Promoter reserves the right to vary these terms and conditions at any time without notice.
19. Personal data relating to the entrants will be used for the purposes of this Promotion in accordance with current GDPR legislation and the Promoter’s Privacy Policy available at https://uk.milwaukeetool.eu/footer/privacy-policy/. The Promoter reserves the right to contact all entrants to verify their personal data.
20. The Promoter shall not be liable for any disruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.
21. In accordance with all relevant legislation and codes of practice, the Promoter reserves the right to suspend or modify this Promotion. If such modification or suspension occurs, Promoter will make a commercially reasonable effort to post notice of such on Promoter’s website.
22. To the extent permitted by law, entrants agree to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, indirect or direct, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the prize, technical difficulties or any malfunction. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.
23. The Promoter, its suppliers or resellers associated with the Promotion shall not be held responsible for any delay, damage or loss caused to the prizes in transit.
24. This Promotion is not available in conjunction with any other offer or promotion.
25. If any provision of this Agreement is held invalid by any law or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
26. This Agreement is governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
